These Terms and Conditions ("Terms") govern your access to and use of ScanKar ("Software", "Service", "Application"). By installing, accessing, or using ScanKar, you agree to be bound by these Terms. If you do not agree, you must not use the software.

1. Definitions

  • ScanKar: A desktop software used for barcode scanning, order verification, and product identification.
  • User / Customer: Any individual or business entity using ScanKar.
  • License: A time-bound, non-transferable right to use the software.
  • Device: The system on which ScanKar is installed and activated.

2. License Grant

ScanKar grants you a limited, non-exclusive, non-transferable, and revocable license to use the software in accordance with these Terms.

  • Each license is valid for a single device only.
  • Licenses cannot be shared, resold, or transferred.

3. License Activation & Validity

  • License activation requires successful payment and device verification.
  • Internet connectivity may be required for activation and periodic validation.
  • License validity depends on the selected subscription plan.
  • Expired licenses may result in restricted or blocked access.

4. Payments & Refunds

  • All payments are processed through authorized payment gateways.
  • Payments are non-refundable unless explicitly stated otherwise.
  • Prices may change without prior notice.
  • Applicable taxes (including GST) may be charged.

5. Free Trial (If Applicable)

  • Free trials are provided once per customer or device.
  • Any attempt to bypass trial restrictions may result in permanent suspension.

6. User Responsibilities

You agree to:

  • Use ScanKar only for lawful business purposes.
  • Maintain accurate configuration for barcodes and SKUs.
  • Keep license credentials secure.
  • Ensure proper use by authorized personnel only.

7. Prohibited Activities

  • Reverse engineering, decompiling, or modifying the software.
  • Sharing or redistributing the software or license.
  • Bypassing license validation or security mechanisms.
  • Using the software for fraudulent or illegal activities.

Violation of these terms may result in immediate license termination without refund.

8. Data & Privacy

  • ScanKar may collect limited technical data for licensing and diagnostics.
  • Customer business data remains the property of the customer.
  • We do not sell customer data to third parties.

9. Service Availability

ScanKar strives for reliable availability but does not guarantee uninterrupted service. Downtime may occur due to maintenance, network issues, or third-party dependencies.

10. Limitation of Liability

ScanKar shall not be liable for any indirect, incidental, or consequential damages, including business loss, revenue loss, or operational delays.

Maximum liability, if any, shall not exceed the amount paid for the license.

11. Warranty Disclaimer

ScanKar is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied.

12. Termination

We reserve the right to suspend or terminate licenses for violations of these Terms, misuse, or illegal activities without prior notice.

13. Updates & Modifications

ScanKar may release updates or enhancements from time to time. Some updates may be mandatory for continued use.

14. Governing Law

These Terms shall be governed by the laws of India. All disputes shall be subject to the jurisdiction of Indian courts.

15. Changes to Terms

We may update these Terms at any time. Continued use of ScanKar constitutes acceptance of the revised Terms.
